中華人民共和國(guó)進(jìn)出境動(dòng)植物檢疫法

　　Law of people's Republic of China on the Entry and Exit Animal and Plant Quarantine

　　第一章總則

　　CHAPTER I GENERAL PROVISIONS

　　第一條為防止動(dòng)物傳染病、寄生蟲(chóng)病和植物危險(xiǎn)性病、蟲(chóng)、雜草以及其他有害生物(以下簡(jiǎn)稱病蟲(chóng)害)傳入、傳出國(guó)境，保護(hù)農(nóng)、林、牧，漁業(yè)生產(chǎn)和人體健康，促進(jìn)對(duì)外經(jīng)濟(jì)貿(mào)易的發(fā)展，制定本法。

　　Article 1 This Law is formulated for the purpose of preventing infectious or parasitic diseases of animals, diseases, insect pests and weeds dangerous to plants, and other harmful organisms (hereinafter referred to, for short, as diseases, insect pests and harmful organisms) from spreading into or out of the country, protecting the production of agriculture, forestry, animal husbandry and fishery as well as human health, and promoting the development of foreign economic relations and trade.

　　第二條進(jìn)出境的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，裝載動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物的裝載容器、包裝物，以及來(lái)自動(dòng)植物疫區(qū)的運(yùn)輸工具，依照本法規(guī)定實(shí)施檢疫。

　　Article 2 Animals and plants, their products and other quarantine objects, containers and packaging materials used for carrying animals and plants, their products or other quarantine objects, as well as means of transport from animal or plant epidemic areas shall, on entry or exit, be subject to quarantine inspection in accordance with this Law.

　　第三條國(guó)務(wù)院設(shè)立動(dòng)植物檢疫機(jī)關(guān)(以下簡(jiǎn)稱國(guó)家動(dòng)植物檢疫機(jī)關(guān))，統(tǒng)一管理全國(guó)進(jìn)出境動(dòng)植物檢疫工作。

　　Article 3 An animal and plant quarantine department shall be instituted under the State Council (hereinafter referred to, for short, as the State animal and plant quarantine department), which shall conduct a unified administration of the entry and exit animal and plant quarantine in the whole country.

　　國(guó)家動(dòng)植物檢疫機(jī)關(guān)在對(duì)外開(kāi)放的口岸和進(jìn)出境動(dòng)植物檢疫業(yè)務(wù)集中的地點(diǎn)設(shè)立的口岸動(dòng)植物檢疫機(jī)關(guān)，依照本法規(guī)定實(shí)施進(jìn)出境動(dòng)植物檢疫。

　　Port animal and plant quarantine offices set up by the State animal and plant quarantine department at ports open to the outside world and at places busy with entry and exit animal and plant quarantine shall, in accordance with this Law, carry out entry and exit animal and plant quarantine.

　　貿(mào)易性動(dòng)物產(chǎn)品出境的檢疫機(jī)關(guān)，由國(guó)務(wù)院根據(jù)實(shí)際情況規(guī)定。

　　The department in charge of the quarantine of animal products leaving the country for trade purposes shall be designated by the State Council as it deems appropriate.

　　國(guó)務(wù)院農(nóng)業(yè)行政主管部門(mén)主管全國(guó)進(jìn)出境動(dòng)植物檢疫工作。

　　The department of agriculture administration under the State Council shall be in charge of the entry and exit animal and plant quarantine in the whole country.

　　第四條口岸動(dòng)植物檢疫機(jī)關(guān)在實(shí)施檢疫時(shí)可以行使下列職權(quán)：

　　Article 4 A port animal and plant quarantine office may exercise the following functions and powers when performing quarantine inspection:

　　(一)依照本法規(guī)定登船、登車(chē)、登機(jī)實(shí)施檢疫；

　　(1) Embarking on a ship, a vehicle or an airplane to perform quarantine under this Law;

　　(二)進(jìn)入港口、機(jī)場(chǎng)、車(chē)站、郵局以及檢疫物的存放、加工、養(yǎng)殖、種植場(chǎng)所實(shí)施檢疫，并依照規(guī)定采樣；

　　(2) Entering a seaport, an airport, a railway or coach station, a post office or a site where quarantine objects are stored, processed, bred or cultivated, to perform quarantine inspection and collect samples according to relevant regulations;

　　(三)根據(jù)檢疫需要，進(jìn)入有關(guān)生產(chǎn)、倉(cāng)庫(kù)等場(chǎng)所，進(jìn)行疫情監(jiān)測(cè)、調(diào)查和檢疫監(jiān)督管理；

　　(3) Entering a site relating to production or storage according to the needs of quarantine, to carry out epidemic monitoring and investigations or quarantine supervision and control;

　　(四)查閱、復(fù)制、摘錄與檢疫物有關(guān)的運(yùn)行日志、貨運(yùn)單、合同、發(fā)票以及其他單證。

　　(4) Consulting, making copies of or excerpts from operational diaries, bills of lading, contracts, invoices or other documents relating to the quarantine objects.

　　第五條國(guó)家禁止下列各物進(jìn)境：

　　Article 5 The State shall prohibit the following objects from entering the country:

　　(一)動(dòng)植物病原體(包括菌種、毒種等)、害蟲(chóng)及其他有害生物；

　　(1) Pathogenic micro-organisms (including seed cultures of bacteria and viruses) of animals and plants, insect pests and other harmful organisms;

　　(二)動(dòng)植物疫情流行的國(guó)家和地區(qū)的有關(guān)動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物；

　　(2) Relevant animals and plants, their products and other quarantine objects from countries or regions with prevalent epidemic animal or plant diseases;

　　(三)動(dòng)物尸體；

　　(3) Animal carcasses; and

　　(四)土壤。

　　(4) Soil.

　　口岸動(dòng)植物檢疫機(jī)關(guān)發(fā)現(xiàn)有前款規(guī)定的禁止進(jìn)境物的，作退回或者銷(xiāo)毀處理。

　　When a port animal and plant quarantine office discovers any objects prohibited from entering the country as prescribed in the preceding paragraph, such objects shall be returned or destroyed.

　　因科學(xué)研究等特殊需要引進(jìn)本條第一款規(guī)定的禁止進(jìn)境物的，必須事先提出申請(qǐng)，經(jīng)國(guó)家動(dòng)植物檢疫機(jī)關(guān)批準(zhǔn)。

　　Whoever, because of special needs such as scientific research, imports any objects prohibited from entering the country as prescribed in the first paragraph of this Article, must submit an application in advance, which shall be subject to the approval by the State animal and plant quarantine department.

　　本條第一款第二項(xiàng)規(guī)定的禁止進(jìn)境物的名錄，由國(guó)務(wù)院農(nóng)業(yè)行政主管部門(mén)制定并公布。

　　The catalogues of objects prohibited from entering the country as prescribed in (2) of the first paragraph of this Article shall be worked out and announced by the department of agriculture administration under the State Council.

　　第六條國(guó)外發(fā)生重大動(dòng)植物疫情并可能傳入中國(guó)時(shí)，國(guó)務(wù)院應(yīng)當(dāng)采取緊急預(yù)防措施，必要時(shí)可以下令禁止來(lái)自動(dòng)植物疫區(qū)的運(yùn)輸工具進(jìn)境或者封鎖有關(guān)口岸；

　　Article 6 In the event that a serious animal or plant epidemic occurs abroad and is liable to spread into the country, the State Council shall adopt emergent preventive measures and may, when necessary, issue orders to prohibit means of transport from animal or plant epidemic areas from entering the country or to blockade the relevant ports;

　　受動(dòng)植物疫情威脅地區(qū)的地方人民政府和有關(guān)口岸動(dòng)植物檢疫機(jī)關(guān)，應(yīng)當(dāng)立即采取緊急措施，同時(shí)向上級(jí)人民政府和國(guó)家動(dòng)植物檢疫機(jī)關(guān)報(bào)告。

　　the local peoples' governments in areas threatened by the animal or plant epidemic as well as the port animal and plant quarantine of fices concerned shall immediately take emergency measures, and, at the same time, report to the People's governments at higher levels and the State animal and plant quarantine department.

　　郵電、運(yùn)輸部門(mén)對(duì)重大動(dòng)植物疫情報(bào)告和送檢材料應(yīng)當(dāng)優(yōu)先傳送。

　　The departments of posts and telecommunications and departments of transportation shall give priority to transmitting or transporting reports concerning serious animal or plant epidemic or materials to be sent for quarantine inspection.

　　第七條國(guó)家動(dòng)植物檢疫機(jī)關(guān)和口岸動(dòng)植物檢疫機(jī)關(guān)對(duì)進(jìn)出境動(dòng)植物、動(dòng)植物產(chǎn)品的生產(chǎn)、加工、存放過(guò)程，實(shí)行檢疫監(jiān)督制度。

　　Article 7 The State animal and plant quarantine department and port animal and plant quarantine offices shall practise a quarantine supervision system in relation to the procedures in the production, processing and storage of animals and plants and their products for entry or exit.

　　第八條口岸動(dòng)植物檢疫機(jī)關(guān)在港口、機(jī)場(chǎng)、車(chē)站、郵局執(zhí)行檢疫任務(wù)時(shí)，海關(guān)、交通、民航、鐵路、郵電等有關(guān)部門(mén)應(yīng)當(dāng)配合。

　　Article 8 When a port animal and plant quarantine office is carrying out its tasks of quarantine inspection in seaports, airports, railway or coach stations, or post offices, relevant departments such as the Customs, departments of communications, civil aviation, or railways, and postal services shall coordinate therewith.

　　第九條動(dòng)植物檢疫機(jī)關(guān)檢疫人員必須忠于職守，秉公執(zhí)法。

　　Article 9 Any quarantine functionary of an animal and plant quarantine organ must be devoted to his or her duties and enforce the law impartially.

　　動(dòng)植物檢疫機(jī)關(guān)檢疫人員依法執(zhí)行公務(wù)，任何單位和個(gè)人不得阻撓。

　　No unit or individual may obstruct a quarantine functionary of an animal and plant quarantine organ from carrying out his or her duties according to law.

　　第二章進(jìn)境檢疫

　　CHAPTER II ENTRY QUARANTINE

　　第十條輸入動(dòng)物、動(dòng)物產(chǎn)品、植物種子、種苗等其他繁殖材料的，必須事先提出申請(qǐng)，辦理檢疫審批手續(xù)。

　　Article 10 Whoever imports animals, animal products, plant seeds, seedlings or other propagating materials must submit an application in advance and go through the formalities for examination and approval of quarantine inspection.

　　第十一條通過(guò)貿(mào)易、科技合作、交換、贈(zèng)送、援助等方式輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物的，應(yīng)當(dāng)在合同或者協(xié)議中訂明中國(guó)法定的檢疫要求，并訂明必須附有輸出國(guó)家或者地區(qū)政府動(dòng)植物檢疫機(jī)關(guān)出具的檢疫證書(shū)。

　　Article 11 Whoever imports animals and plants, their products or other quarantine objects through trade, scientific and technological cooperation, exchanges, donations or aid shall specify in the contracts or agreements the requirements for quarantine inspection prescribed by China's law and the necessity of quarantine certificates issued by the animal and plant quarantine department under the government of the exporting country or region being appended therewith.

　　第十二條貨主或者其代理人應(yīng)當(dāng)在動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物進(jìn)境前或者進(jìn)境時(shí)持輸出國(guó)家或者地區(qū)的檢疫證書(shū)、貿(mào)易合同等單證，向進(jìn)境口岸動(dòng)植物檢疫機(jī)關(guān)報(bào)檢。

　　Article 12 The owner or his or her agent shall apply to the port animal and plant quarantine office at the port of entry for quarantine inspection of the animals and plants, their products or other quarantine objects, before or on their entry, on the strength of documents such as the quarantine certificates issued by the exporting country or region and the trade contracts.

　　第十三條裝載動(dòng)物的運(yùn)輸工具抵達(dá)口岸時(shí)，口岸動(dòng)植物檢疫機(jī)關(guān)應(yīng)當(dāng)采取現(xiàn)場(chǎng)預(yù)防措施，對(duì)上下運(yùn)輸工具或者接近動(dòng)物的人員、裝載動(dòng)物的運(yùn)輸工具和被污染的場(chǎng)地作防疫消毒處理。

　　Article 13 On arrival at a port of a means of transport for carrying animals, the port animal and plant quarantine office shall for the prevention of epidemics adopt on-the-spot preventive measures and conduct disinfection of persons embarking on or disembarking from the means of transport or having contracts with the animals, the means of transport for carrying the animals and the contaminated fields.

　　第十四條輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，應(yīng)當(dāng)在進(jìn)境口岸實(shí)施檢疫。

　　Article 14 Import animals and plants, their products and other quarantine objects shall be quarantined at the port of entry;

　　未經(jīng)口岸動(dòng)植物檢疫機(jī)關(guān)同意，不得卸離運(yùn)輸工具。

　　without consent of the port animal and plant quarantine office, the same shall not be unloaded from the means of transport.

　　輸入動(dòng)植物，需隔離檢疫的，在口岸動(dòng)植物檢疫機(jī)關(guān)指定的隔離場(chǎng)所檢疫。

　　The import animals and plants that need to be placed in isolation for quarantine inspection shall be quarantined in an isolation court designated by the port animal and plant quarantine office.

　　因口岸條件限制等原因，可以由國(guó)家動(dòng)植物檢疫機(jī)關(guān)決定將動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物運(yùn)往指定地點(diǎn)檢疫。

　　By reason of limited conditions at the port of entry, the State animal and plant quarantine department may decide to have the animals and plants, their products or other quarantine objects transported to a designated place for quarantine inspection.

　　在運(yùn)輸、裝卸過(guò)程中，貨主或者其代理人應(yīng)當(dāng)采取防疫措施。

　　In the course of transportation, loading and unloading, the owner or his or her agent shall take preventive measures against epidemics.

　　指定的存放、加工和隔離飼養(yǎng)或者隔離種植的場(chǎng)所，應(yīng)當(dāng)符合動(dòng)植物檢疫和防疫的規(guī)定。

　　Designated places for storage, processing, isolated feeding or planting shall conform to the provisions on animal and plant quarantine and epidemic prevention.

　　第十五條輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，經(jīng)檢疫合格的，準(zhǔn)予進(jìn)境；

　　Article 15 The import animals and plants, their products or other quarantine objects that pass the quarantine inspection are allowed to enter the country;

　　海關(guān)憑口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)的檢疫單證或者在報(bào)單上加蓋的印章驗(yàn)放。

　　the Customs shall, after verification, release the same on the strength of the quarantine certificates issued, or the stamps on the customs declaration forms affixed, by the port animal and plant quarantine office.

　　輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，需調(diào)離海關(guān)監(jiān)管區(qū)檢疫的，海關(guān)憑口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)的《檢疫調(diào)離通知單》驗(yàn)放。

　　In respect of the import animals and plants, their products or other quarantine objects that need to be transferred away from a customs surveillance zone for quarantine inspection, the Customs shall, after verification, release the same on the strength of the Quarantine Transference Notice issued by the port animal and plant quarantine office.

　　第十六條輸入動(dòng)物，經(jīng)檢疫不合格的，由口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)《檢疫處理通知單》，通知貨主或者其代理人作如下處理：

　　Article 16 In respect of the import animals that fail in the quarantine inspection, the port animal and plant quarantine office shall issue the Quarantine Treatment Notice notifying the owner or his or her agent to deal with the said animals in either of the following manners:

　　(一)檢出一類傳染病、寄生蟲(chóng)病的動(dòng)物，連同其同群動(dòng)物全群退回或者全群撲殺并銷(xiāo)毀尸體；

　　(1) The animals that are found suffering from Class A infectious or parasitic diseases, shall, together with all the other in-contact animals, be returned or slaughtered with their carcasses destroyed; or

　　(二)檢出二類傳染病、寄生蟲(chóng)病的動(dòng)物，退回或者撲殺，同群其他動(dòng)物在隔離場(chǎng)或者其他指定地點(diǎn)隔離觀察。

　　(2) The animals that are found suffering from Class B infectious or parasitic diseases shall be returned or slaughtered; and the other in- contact animals shall be placed in an isolation camp or any other designated place for observation.

　　輸入動(dòng)物產(chǎn)品和其他檢疫物經(jīng)檢疫不合格的，由口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)《檢疫處理通知單》，通知貨主或者其代理人作除害、退回或者銷(xiāo)毀處理。經(jīng)除害處理合格的，準(zhǔn)予進(jìn)境。

　　In respect of import animal products or other quarantine objects that fail in the quarantine inspection, the port animal and plant quarantine office shall issue the Quarantine Treatment Notice notifying the owner or his or her agent to conduct such treatments as disinfection and disinfestation, returning or destruction. The products or objects that pass the quarantine inspection after a treatment of disinfection and disinfestation are allowed to enter the country.

　　第十七條輸入植物、植物產(chǎn)品和其他檢疫物，經(jīng)檢疫發(fā)現(xiàn)有植物危險(xiǎn)性病、蟲(chóng)、雜草的，由口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)《檢疫處理通知單》，通知貨主或者其代理人作除害、退回或者銷(xiāo)毀處理。

　　Article 17 On discovering through quarantine inspection that import plants, plant products or other quarantine objects are contaminated with diseases, pests or weeds dangerous to plants, the port animal and plant quarantine office shall issue the Quarantine Treatment Notice notifying the owner or his or her agent to conduct such treatments as disinfection and disinfestation, returning or destruction.

　　經(jīng)除害處理合格的，準(zhǔn)予進(jìn)境。

　　Those that pass the quarantine inspection after a treatment of disinfection and disinfestation are allowed to enter the country.

　　第十八條本法第十六條第一款第一項(xiàng)、第二項(xiàng)所稱一類、二類動(dòng)物傳染病、寄生蟲(chóng)病的名錄和本法第十七條所稱植物危險(xiǎn)性病、蟲(chóng)、雜草的名錄，由國(guó)務(wù)院農(nóng)業(yè)行政主管部門(mén)制定本公布。

　　Article 18 The catalogues of the Class A and Class B infectious or parasitic diseases of animals specified in Article 16, paragraph 1, Items 1 and 2 of this Law and the catalogues of the diseases, pests or weeds dangerous to plants specified in Article 17 of this Law shall be worked out and announced by the department of agriculture administration under the State Council.

　　第十九條輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，經(jīng)檢疫發(fā)現(xiàn)有本法第十八條規(guī)定的名錄之外，對(duì)農(nóng)、林、牧、漁業(yè)有嚴(yán)重危險(xiǎn)的其他病蟲(chóng)害的，由口岸動(dòng)植物檢疫機(jī)關(guān)依照國(guó)務(wù)院農(nóng)業(yè)行政主管部門(mén)的規(guī)定，通知貨主或者其代理人作除害、退回或者銷(xiāo)毀處理。

　　Article 19 On discovering through quarantine inspection that import animals and plants, their products or other quarantine objects are contaminated with diseases, insect pests or harmful organisms which are not covered by the catalogues specified in Article 18 of this Law but are extremely harmful to agriculture, forestry, animal husbandry and fishery, the port animal and plant quarantine office shall, in accordance with relevant regulations of the department of agriculture administration under the State Council, notify the owner or his or her agent to conduct such treatments as disinfection and disinfestation, returning or destruction.

　　經(jīng)除害處理合格的，準(zhǔn)予進(jìn)境。

　　Those that pass the quarantine inspection after a treatment of disinfection and disinfestation are allowed to enter the country.

　　第三章出境檢疫

　　CHAPTER III EXIT QUARANTINE

　　第二十條貨主或者其代理人在動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物出境前，向口岸動(dòng)植物檢疫機(jī)關(guān)報(bào)檢。

　　Article 20 The owner, or his or her agent, of exit animals and plants, their products or other quarantine objects shall, before their exit, submit an application for quarantine inspection to the port animal and plant quarantine office.

　　出境前需經(jīng)隔離檢疫的動(dòng)物，在口岸動(dòng)植物檢疫機(jī)關(guān)指定的隔離場(chǎng)所檢疫。

　　The animals that need to the placed in isolation for quarantine inspection before exit shall be quarantined in an isolation court designated by the port animal and plant quarantine office.

　　第二十一條輸出動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，由口岸動(dòng)植物檢疫機(jī)關(guān)實(shí)施檢疫，經(jīng)檢疫合格或者經(jīng)除害處理合格的，準(zhǔn)予出境；

　　Article 21 Export animals and plants, their products or other quarantine objects shall be quarantined by the port animal and plant quarantine office, and those that pass the quarantine inspection or conform to the standards after a treatment of disinfection and disinfestation are allowed to leave the country.

　　海關(guān)憑口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)的檢疫證書(shū)或者在報(bào)關(guān)單上加蓋的印章驗(yàn)放。

　　The Customs shall, after verification, release the same on the strength of the quarantine certificates issued, or the stamps on the customs declaration forms affixed, by the port animal and plant quarantine office.

　　檢疫不合格又無(wú)有效方法作除害處理的，不準(zhǔn)出境。

　　Those that fail in the quarantine inspection and are unable to be treated by disinfection and disinfestation with effective methods shall not be allowed to leave the country.

　　第二十二條經(jīng)檢疫合格的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，有下列情形之一的，貨主或者其代理人應(yīng)當(dāng)重新報(bào)檢：

　　Article 22 Where the animals and plants, their products or other quarantine objects that pass the quarantine inspection are involved in any of the following circumstances, the owner or his or her agent shall re-apply for quarantine inspection:

　　(一)更改輸入國(guó)家或者地區(qū)，更改好的輸入國(guó)家或者地區(qū)又有不同檢疫要求的；

　　(1) Where the importing country or region is changed, and the changed importing country or region has different requirements for quarantine inspection;

　　(二)改換包裝或者原未拼裝后來(lái)拼裝的；

　　(2) Where the packings are changed or the unpacked products or objects are subsequently packed;

　　(三)超過(guò)檢疫規(guī)定有效期的。

　　(3) Where the stipulated valid period of quarantine is exceeded.

　　第四章過(guò)境檢疫

　　CHAPTER IV TRANSIT QUARANTINE

　　第二十三條要求運(yùn)輸動(dòng)物過(guò)境的，必須事先商得中國(guó)國(guó)家動(dòng)植物檢疫機(jī)關(guān)同意，并按照指定的口岸和路線過(guò)境。

　　Article 23 Whoever requests a transit of animals through the Chinese territory must obtain in advance and through consultation the consent of China's State animal and plant quarantine department and the transit must be conducted through the designated port and route.

　　裝載過(guò)境動(dòng)物的運(yùn)輸工具、裝載容器、飼料和鋪墊材料，必須符合中國(guó)動(dòng)植物檢疫的規(guī)定。

　　The means of transport, containers, feeding stuffs and bedding materials for the animals in transit must all conform to China's regulations on animal and plant quarantine.

　　第二十四條運(yùn)輸動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物過(guò)境的，由承運(yùn)人或者押運(yùn)人持貨運(yùn)單和輸出國(guó)家或者地區(qū)政府動(dòng)植物檢疫機(jī)關(guān)出具的檢疫證書(shū)，在進(jìn)境時(shí)向口岸動(dòng)植物檢疫機(jī)關(guān)報(bào)檢，出境口岸不再檢疫。

　　Article 24 The transit of animals and plants, their products or other quarantine objects requires the consignor or the escort to submit at the port of entry the bills of lading and the quarantine certificates issued by the animal and plant quarantine department under the government of the exporting country or region to the port animal and plant quarantine office for quarantine inspection. No further quarantine inspection is needed at the port of exit.

　　第二十五條過(guò)境的動(dòng)物經(jīng)檢疫合格的，準(zhǔn)予過(guò)境；發(fā)現(xiàn)有本法第十八條規(guī)定的名錄所列的動(dòng)物傳染病、寄生蟲(chóng)病的，全群動(dòng)物不準(zhǔn)過(guò)境。

　　Article 25 The transit animals that pass the quarantine inspection are allowed to pass through the country; and in case any infectious or parasitic disease of animals specified in the catalogues as stipulated in Article 18 of this Law is discovered, the entire flock of the animals shall not be allowed to transit.

　　過(guò)境動(dòng)物的飼料受病蟲(chóng)害污染的，作除害、不準(zhǔn)過(guò)境或者銷(xiāo)毀處理。

　　The transit animals' feeding stuffs that are contaminated with diseases, insect pests or harmful organisms shall be subjected to such treatments as disinfection and disinfestation, denial of transit or destruction.

　　過(guò)境的動(dòng)物的尸體、排泄物、鋪墊材料及其他廢棄物，必須按照動(dòng)植物檢疫機(jī)關(guān)的規(guī)定處理，不得擅自拋棄。

　　The carcasses, excrements, bedding materials and other wastes of the transit animals must be disposed of in accordance with the regulations of the animal and plant quarantine department, and may not be cast away without authorization.

　　第二十六條對(duì)過(guò)境植物、動(dòng)植物產(chǎn)品和其他檢疫物，口岸動(dòng)植物檢疫機(jī)關(guān)檢查運(yùn)輸工具或者包裝，經(jīng)檢疫合格的，準(zhǔn)予過(guò)境；

　　Article 26 The port animal and plant quarantine office shall examine the means of transport and the packings, in respect of the transit plants, animal and plant products or other quarantine objects, which are allowed to transit through the country if they pass the quarantine inspection;

　　發(fā)現(xiàn)有本法第十八條規(guī)定的名錄所列的病蟲(chóng)害的，作除害處理或者不準(zhǔn)過(guò)境。

　　in case any disease, insect pest or harmful organism specified in the catalogues as stipulated in Article 18 of this Law is discovered, it shall be subjected to a treatment of disinfection and disinfestation or denial of transit.

　　第二十七條動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物過(guò)境期間，未經(jīng)動(dòng)植物檢疫機(jī)關(guān)批準(zhǔn)，不得開(kāi)拆包裝或者卸離運(yùn)輸工具。

　　Article 27 Animals and plants, their products or other quarantine objects, in the course of their transit, may not be unpacked or discharged from the means of transport without the approval of the animal and plant quarantine organ.

　　第五章攜帶、郵寄物檢疫

　　CHAPTER V QUARANTINE OF MATERIALS CARRIED BY PASSENGERS OR BY POST

　　第二十八條攜帶、郵寄植物種子、種苗以及其繁殖材料進(jìn)境的，必須事先提出申請(qǐng)，辦理檢疫審批手續(xù)。

　　Article 28 Whoever intends to carry or post plant seeds, seedlings or other propagating materials into the country must submit an application in advance and go through the formalities for examination and approval of quarantine inspection.

　　第二十九條禁止攜帶、郵寄進(jìn)境的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物的名錄，由國(guó)務(wù)院農(nóng)業(yè)行政主管部門(mén)制定并公布。

　　Article 29 The catalogues of the animals and plants, their products and other quarantine objects that are not allowed to be carried or posted into the country shall be worked out and announced by the department of agriculture administration under the State Council.

　　攜帶、郵寄前款規(guī)定的名錄所列的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物進(jìn)境的，作退回或者銷(xiāo)毀處理。

　　In case any animals or plants, animal or plant products or other quarantine objects specified in the catalogues mentioned in the preceding paragraph are carried or posted into the country, they shall either be returned or destroyed.

　　第三十條攜帶本法第二十九條規(guī)定的名錄以外的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物進(jìn)境的，在進(jìn)境時(shí)向海關(guān)申報(bào)并接受口岸動(dòng)物檢疫機(jī)關(guān)檢疫。

　　Article 30 Whoever enters the country carrying animals or plants, animal or plant products or other quarantine objects which are not included in the catalogues specified in Article 29 of this Law shall declare them to the Customs at the port of entry and accept the quarantine inspection by the port animal and plant quarantine office.

　　攜帶動(dòng)物進(jìn)境的，必須持有輸出國(guó)家或者地區(qū)的檢疫證書(shū)等證件。

　　Whoever carries animals into the country must hold such papers as quarantine certificates issued by the exporting country or region.

　　第三十一條郵寄本法第二十九條規(guī)定的名錄以外的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物進(jìn)境的，由口岸動(dòng)植物檢疫機(jī)關(guān)在國(guó)際郵件互換局實(shí)施檢疫，必要時(shí)可以取回口岸動(dòng)植物檢疫機(jī)關(guān)檢疫；未經(jīng)檢疫不得運(yùn)遞。

　　Article 31 The port animal and plant quarantine office shall, in respect of the animals and plants, their products or other quarantine objects not included in the catalogues specified in Article 29 of this Law, carry out quarantine inspection at the International Postage Exchange Bureau, or, when necessary, take the same back to the port animal and plant quarantine office for quarantine inspection; and the same shall not be transported or delivered without undergoing quarantine inspection.

　　第三十二條郵寄進(jìn)境的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，經(jīng)檢疫或者除害處理合格后放行；

　　Article 32 Animals or plants, animal or plant products or other quarantine objects that enter the country by post shall be released if they pass the quarantine inspection or conform to the standards after the treatment of disinfection and disinfestation;

　　經(jīng)檢疫不合格又無(wú)有效方法作除害處理的，作退回或者銷(xiāo)毀處理，并簽發(fā)《檢疫處理通知單》。

　　those that fail in quarantine inspection and are unable to be treated by disinfection and disinfestation with effective methods shall be returned or destroyed, and the Quarantine Treatment Notice shall be issued.

　　第三十三條攜帶、郵寄出境的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，物主有檢疫要求的，由口岸動(dòng)植物檢疫機(jī)關(guān)實(shí)施檢疫。

　　Article 33 The animals or plants, animal or plant products or other quarantine objects that are carried or posted out of the country shall be quarantined by the port animal and plant quarantine office, upon request by the owner thereof.

　　第六章運(yùn)輸工具檢疫

　　CHAPTER VI QUARANTINE OF MEANS OF TRANSPORT

　　第三十四條來(lái)自動(dòng)植物疫區(qū)的船舶、飛機(jī)、火車(chē)抵達(dá)口岸時(shí)，由口岸動(dòng)植物檢疫機(jī)關(guān)實(shí)施檢疫。

　　Article 34 Ships, airplanes or trains from the animal or plant epidemic areas shall, upon their arrival at the port, be quarantined by the port animal and plant quarantine office.

　　發(fā)現(xiàn)有本法第十八條規(guī)定的名錄所列的病蟲(chóng)害的，作不準(zhǔn)帶離運(yùn)輸工具、除害、封存或者銷(xiāo)毀處理。

　　In the event any disease, insect pest or harmful organism specified in the catalogues mentioned in Article 18 of this Law is discovered, the cargoes shall be subjected to such treatments as prohibition from discharge from the means of transport, disinfection and disinfestation, sealing up or destruction.

　　第三十五條進(jìn)境的車(chē)輛、由口岸動(dòng)植物檢疫機(jī)關(guān)作防疫消毒處理。

　　Article 35 Vehicles entering the country shall be disinfected for epidemic prevention by the port animal and plant quarantine office.

　　第三十六條進(jìn)出境運(yùn)輸工具上的泔水、動(dòng)植物性廢棄物，依照口岸動(dòng)植物檢疫機(jī)關(guān)的規(guī)定處理，不得擅自拋棄。

　　Article 36 The swills and wastes of animal or plant nature on the means of transport entering or leaving the country shall be disposed of in accordance with the regulations of the port animal and plant quarantine office and may not be cast away without authorization.

　　第三十七條裝載出境的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物的運(yùn)輸工具，應(yīng)當(dāng)符合動(dòng)植物檢疫和防疫的規(guī)定。

　　Article 37 The means of transport carrying export animals and plants, their products or other quarantine objects shall conform to the regulations on animal and plant quarantine and epidemic prevention.

　　第三十八條進(jìn)境供拆船用的廢舊船舶，由口岸動(dòng)植物檢疫機(jī)關(guān)實(shí)施檢疫，發(fā)現(xiàn)有本法第十八條規(guī)定的名錄所列的病蟲(chóng)害的，作除害處理。

　　Article 38 The old and disused ships entering the country for disassembling purposes shall be quarantined by the port animal and plant quarantine office. In the event that diseases, insect pests or harmful organisms specified in the catalogues mentioned in Article 18 of this Law are discovered, the said ships shall be subjected to a treatment of disinfection and disinfestation.

　　第七章法律責(zé)任

　　CHAPTER VII LEGAL RESPONSIBILITY

　　第三十九條違反本法規(guī)定，有下列行為之一的，由口岸動(dòng)植物檢疫機(jī)關(guān)處以罰款：

　　Article 39 Whoever, in violation of this Law, commits any of the following acts shall be fined by the port animal and plant quarantine office:

　　(一)未報(bào)檢或者未依法辦理檢疫審批手續(xù)的；

　　(1) Failing to apply for quarantine inspection or failing to go through the formalities for examination and approval of quarantine inspection in accordance with the law;

　　(二)未經(jīng)口岸動(dòng)植物檢疫機(jī)關(guān)許可擅自將進(jìn)境動(dòng)植物、動(dòng)植物產(chǎn)品或者其他檢疫物卸離運(yùn)輸工具或者運(yùn)遞的；

　　(2) Unloading animals or plants, animal or plant products or other quarantine objects entering the country from the means of transport or transporting or delivering the same, without permission of the port animal and plant quarantine office;

　　(三)擅自調(diào)離或者處理在口岸動(dòng)植物檢疫機(jī)關(guān)指定的隔離場(chǎng)所中隔離檢疫的動(dòng)植物的。

　　(3) Transferring or disposing of, without authorization, the animals or plants subjected to quarantine inspection in an isolation court designated by the port animal and plant quarantine office.

　　第四十條報(bào)檢的動(dòng)植物、動(dòng)植物產(chǎn)品或者其他檢疫物與實(shí)際不符合的，由口岸動(dòng)植物檢疫機(jī)關(guān)處以罰款；已取得檢疫單證的，予以吊銷(xiāo)。

　　Article 40 Where the animals or plants, animal or plant products or other quarantine objects declared for quarantine inspection do not conform to the actual conditions, the applicant shall be fined by the port animal and plant quarantine office; and the quarantine certificates already obtained shall be revoked.

　　第四十一條違反本法規(guī)定，擅自開(kāi)拆過(guò)境動(dòng)植物、動(dòng)植物產(chǎn)品或者其他檢疫物的包裝的，擅自將過(guò)境動(dòng)植物、動(dòng)植物產(chǎn)品或者其他檢疫物卸離運(yùn)輸工具的，擅自拋棄過(guò)境動(dòng)物的尸體、排泄物、鋪墊材料或者其他廢棄物的，有動(dòng)植物檢疫機(jī)關(guān)處以罰款。

　　Article 41 Whoever, in violation of this Law and without authorization, unpacks the packings of transit animals or plants, animal or plant products or other quarantine objects, discharges transit animals or plants, animal or plant products or other quarantine objects from the means of transport, or casts away transit animals' carcasses, excrements, bedding materials or other wastes, shall be fined by the port animal and plant quarantine office.

　　第四十二條違反本法規(guī)定，引起重大動(dòng)植物疫情的，比照刑法第一百七十八條的規(guī)定追究刑事責(zé)任。

　　Article 42 Whoever violates the provisions of this Law and causes a serious animal or plant epidemic shall be investigated for criminal responsibility by applying mutatis mutandis the provisions of Article 178 of the Criminal Law.

　　第四十三條偽造、變?cè)鞕z疫單證、印章、標(biāo)志、封識(shí)，依照刑法第一百六十七條的規(guī)定追究刑事責(zé)任。

　　Article 43 Whoever forges or alters the quarantine certificates, stamps, marks or seals shall be investigated for criminal responsibility in accordance with the provisions of Article 167 of the Criminal Law.

　　第四十四條當(dāng)事人對(duì)動(dòng)植物檢疫機(jī)關(guān)的處罰決定不服的，可以在接到處罰通知之日起十五日內(nèi)向作出處罰決定的機(jī)關(guān)的上一級(jí)機(jī)關(guān)申請(qǐng)復(fù)議；

　　Article 44 If a party is not satisfied with the decision on punishment made by an animal and plant quarantine organ, it may, within 15 days after receipt of the notification of the punishment, apply for reconsideration to the organ at the next higher level over the organ that has made the decision on punishment;

　　當(dāng)事人也可以在接到處罰通知之日起十五日內(nèi)直接向人民法院起訴。

　　the party may also directly bring a suit in a people's court within 15 days after receipt of the notification of the punishment.

　　復(fù)議機(jī)關(guān)應(yīng)當(dāng)在接到復(fù)議申請(qǐng)之日起六十日內(nèi)作出復(fù)議決定。

　　The reconsideration organ shall, within 60 days after receipt of the application for reconsideration, make a reconsideration decision.

　　當(dāng)事人對(duì)復(fù)議決定不服的，可以在接到復(fù)議決定之日起十五日內(nèi)向人民法院起訴。

　　If the party is not satisfied with the reconsideration decision, it may, within 15 days after receipt of the reconsideration decision, bring a suit in a people's court.

　　復(fù)議機(jī)關(guān)逾期不作出復(fù)議決定的，當(dāng)事人可以在復(fù)議期滿之日起十五日內(nèi)向人民法院起訴。

　　If the reconsideration organ fails to make a reconsideration decision within the prescribed period, the party may bring a suit within 15 days after the expiration of the period for reconsideration.

　　當(dāng)事人逾期不申請(qǐng)復(fù)議也不向人民法院起訴，又不履行處罰決定的，作出處罰決定的機(jī)關(guān)可以申請(qǐng)人民法院強(qiáng)制執(zhí)行。

　　If the party neither applies for reconsideration within the time limit, nor brings a suit in a people's court, nor complies with the decision on punishment, the organ that has made the decision on punishment may apply to a people's court for compulsory execution.

　　第四十五條動(dòng)植物檢疫機(jī)關(guān)檢疫人員濫用職權(quán)，徇私舞弊，偽造檢疫結(jié)果，或者玩忽職守，延誤檢疫出證，構(gòu)成犯罪的，依法追究刑事責(zé)任；不構(gòu)成犯罪的，給予行政處分。

　　Article 45 Where a quarantine functionary of an animal and plant quarantine organ who abuses his or her power, practises favouritism or embezzlement, forges a quarantine result, or neglects his or her duty or delays the performance of quarantine inspection and the issuance of certificates, criminal responsibility shall be investigated according to law if the offence constitutes a crime; if the offence does not constitute a crime, the offender shall be subjected to administrative sanctions.

　　第八章附則

　　CHAPTER VIII SUPPLEMENTARY PROVISIONS

　　第四十六條本法下列用語(yǔ)的含義是：

　　Article 46 As used in this Law, the following terms respectively mean:

　　(一)"動(dòng)物"是指飼養(yǎng)、野生的活動(dòng)物、如畜、禽、獸、蛇、龜、魚(yú)、蝦、蟹、貝、蠶、蜂等；

　　(1) "Animals" mean the live animals, whether domesticated or wild, such as livestock, poultry, beasts, snakes, tortoises, fishes, shrimps and prawns, crabs, shellfishes, silkworms and bees;

　　(二)"動(dòng)物產(chǎn)品"是指來(lái)源于動(dòng)物未經(jīng)加工或者雖經(jīng)加工但仍有可能傳播疫病的產(chǎn)品，如生皮張、毛類、肉類、臟器、油脂、動(dòng)物水產(chǎn)品、奶制品、蛋類、血液、精液、胚胎、骨、蹄、角等；

　　(2) "Animal products" mean the non-processed products or the processed products, from animals, still liable to spread epidemic diseases, such as raw hides, hairs, meats, viscerae, fat and grease, aquatic animal products, dairy products, eggs, blood, semens, embryos, bones, hoofs and horns;

　　(三)"植物"是指栽培植物、野生植物及其種子、種苗及其他繁殖材料等；

　　(3) "Plants" mean cultivated plants, wild plants, their seeds and seedlings and other propagating materials;

　　(四)"植物產(chǎn)品"是指來(lái)源于植物未經(jīng)加工或者雖經(jīng)加工但仍有可能傳播病蟲(chóng)害的產(chǎn)品，如糧食、豆、棉花、油、麻、煙草、籽仁、干果、鮮果、蔬菜、生藥材、木材、飼料等；

　　(4) "Plant products" mean the non-processed products or the processed products, from plants, still liable to spread diseases, insect pests or harmful organisms, such as grain, beans, cotton, oils, fibres, tobacco, kernel, dried fruits, fresh fruits, vegetables, raw medicinal herbs, logs and feeding stuffs;

　　(五)"其他檢疫物"是指動(dòng)物疫苗、血清、診斷液、動(dòng)植物性廢棄物等。

　　(5) "Other quarantine objects" mean animal vaccine, blood serum, diagnostic reagents, wastes of animal or plant nature.

　　第四十七條中華人民共和國(guó)締結(jié)或者參加的有關(guān)動(dòng)植物檢疫的國(guó)際條約與本法有不同規(guī)定的，適用該國(guó)際條約的規(guī)定。但是，中華人民共和國(guó)聲明保留的條款除外。

　　Article 47 If provisions of this Law contravene those of the international treaties concerning animal and plant quarantine which the People's Republic of China has concluded or to which China is a party, the provisions of the international treaties concerned shall prevail, with the exception of the treaty clauses on which the People's Republic of China has declared reservations.

　　第四十八條口岸動(dòng)植物檢疫機(jī)關(guān)實(shí)施檢疫依照規(guī)定收費(fèi)。收費(fèi)辦法由國(guó)務(wù)院農(nóng)業(yè)行政主管部門(mén)會(huì)同國(guó)務(wù)院物價(jià)等有關(guān)主管部門(mén)制定。

　　Article 48 Port animal and plant quarantine offices shall collect fees, according to relevant regulations, for performing quarantine inspection. The measures for the collection of fees shall be worked out by the department of agriculture administration under the State Council together with the competent departments such as the pricing department under the State Council.

　　第四十九條國(guó)務(wù)院根據(jù)本法制定實(shí)施條例。

　　Article 49 The State Council shall, on the basis of this Law, formulate the implementing regulations.

　　第五十條本法自1992年4月1日起施行。1982年6月4日國(guó)務(wù)院發(fā)布的《中華人民共和國(guó)進(jìn)出口動(dòng)植物檢疫條例》同時(shí)廢止。

　　Article 50 This Law shall come into force as of April 1, 1992. The Regulations of the People's Republic of China on the Import and Export Animal and Plant Quarantine promulgated by the State Council on June 4, 1982 shall be annulled simultaneously.
